This document explains your right to withdraw from a purchase, when that right ends, and how refunds work. It applies to Consumers — natural persons buying for purposes not connected with a trade or profession — and to qualifying sole traders under Article 7aa of the Act on Consumer Rights (consumer-rights regime) and Article 385⁵ of the Civil Code (unfair-contract-term protection), to the extent those statutes require. It forms part of the Terms of Service.
1. The 14-day right
Under Article 27 of the Act of 30 May 2014 on Consumer Rights, you may withdraw from a distance contract within 14 days without giving a reason and without cost, except as described in section 3 for each product type.
The period runs from the day the contract was concluded, which for us is the day your payment is confirmed.
2. How to withdraw
Send us an unequivocal statement before the 14 days expire. Sending it on the last day is enough — it does not have to reach us by then.
- Email: hello@cramdeck.com, subject "Withdrawal"
- Phone: +48 604 550 335
- Post: JMS Sieracki sp. z o.o., ul. ks. Pawła Pośpiecha 3A/7, 41-800 Zabrze, Poland
You may use the model form in section 7, but you do not have to. Any clear statement will do. We confirm receipt by email without delay.
3. Three product regimes
Everything we sell is digital. The withdrawal rules differ depending on what you bought. At checkout we show product-specific statements; neither checkbox is pre-ticked.
3.1 Regular subscription (continuous digital service)
The Regular subscription is a continuous supply of a digital service. Asking us to start the subscription immediately does not extinguish your 14-day right of withdrawal.
At checkout you must:
- expressly request that the service begin before the withdrawal period expires, and
- acknowledge that if you withdraw within 14 days you will owe a proportionate amount for the service supplied until withdrawal and receive a refund of the remainder.
We confirm the contract and those statements on a durable medium (section 4).
If you withdraw within 14 days after requesting early start, you pay only for the days of service actually provided up to withdrawal; we refund the rest and stop renewal. Loss of the withdrawal right for a continuous service applies only after full performance under the statutory conditions — not merely because access started.
After the 14-day period, ordinary cancellation of renewal under the Terms applies.
3.2 AI credit packs (prepaid units under one digital-service agreement)
AI credits are prepaid units of account under one digital-service agreement, used to request later AI generations. Immediate availability requires your express request at checkout. They are not treated as fully performed when you use the first credit.
At checkout you must:
- expressly request that the credits be made available before the withdrawal period expires, and
- acknowledge the settlement model below.
If you withdraw within 14 days, we:
- refund unused credits in the pack (the corresponding price is refunded), and
- settle credits you have already used after that request by a transparent proportionate deduction from the price paid (unit price = pack price ÷ number of credits in the pack, unless a different transparent calculation is shown at checkout).
Using one credit does not extinguish the withdrawal right for the whole pack.
3.3 Individually purchased Decks (digital content)
A purchased Deck is digital content not supplied on a tangible medium. Under Article 38(1)(13) of the Act on Consumer Rights, the right of withdrawal is lost after performance is completed — for an immediately delivered Deck, when the Deck is first made available in your library after payment (the delivery-completion event) — but only if all of the following are true:
- you gave prior express consent to performance beginning before the withdrawal period expires,
- you were informed that you would lose the right of withdrawal after performance is completed,
- you acknowledged that information, and
- we confirmed the contract on a durable medium before the Deck was made available (section 4).
Loss of the right does not follow from delivery merely “starting” without those conditions and without a completed-performance event we can evidence.
Sole checkout path. Access to paid Decks is granted immediately after durable-medium confirmation. Both checkout statements are required. If you do not tick both boxes, the order does not proceed. There is no delayed-supply purchase option that preserves the 14-day right while still buying that Deck online.
4. Durable medium confirmation
For all three product types, confirmation of the contract — including the exact statements shown to you — is:
- sent to you by email before the Paid Service is made available, and
- available to download from your signed-in account: open Profile → Plan / purchases, then use the confirmation download for that payment (the same content is also available to our systems at the secure account API used by that button).
The email confirmation and the downloadable account copy provide the contract information on a durable medium as required by Article 21(1) of the Act on Consumer Rights.
5. Refunds
We refund within 14 days of receiving your withdrawal statement, using the same means of payment you used. You pay no fee for the refund. Depending on your bank, the money may take a few more days to appear.
Refunds we make outside the withdrawal right:
| Situation | What happens |
|---|---|
| We fail to supply digital content that conforms to the contract, and do not fix it after your request | Price reduction or withdrawal under Articles 43h–43q of the Act on Consumer Rights |
| We remove a purchased Deck on objective grounds (illegality, infringement, security risk or loss of necessary rights) and cannot continue access | Appropriate refund or price reduction, or a replacement where reasonably available |
| Duplicate or erroneous charge | Full refund on notification |
| Change of mind after the withdrawal right has lawfully ended | No refund is owed, though we may make one as a gesture |
When a refund is confirmed, we reverse the corresponding entitlement: credits are removed from your balance, a purchased Deck stops being available, and a subscription ends.
Chargebacks and external remedies. Contacting CramDeck support before using a card chargeback, bank dispute or other statutory remedy is optional. It may be faster to resolve some issues with us first, but you are not required to contact us before exercising those rights, and nothing here limits withdrawal, conformity complaints, supervisory complaints, ADR or court rights. If a chargeback or bank dispute is pending, we may suspend the corresponding entitlement until the dispute is resolved.
6. Complaints
The right of withdrawal is separate from a complaint about something not working. For that, see section 12 of the Terms of Service. We answer consumer complaints within 14 days, and if we do not answer a Consumer's complaint in time it is deemed accepted.
7. Model withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.)
